Welcome to Whitestone Super Shark Pools LLC ("Company," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of our website, estimation systems, and any pool repair, structural renovation, equipment installation, or dye leak detection services we provide. By requesting a quote, approving an estimate, or scheduling a job, you agree to these Terms.
 

Scope of Services & Authorizations

  • Property Access: You grant our technicians safe, unobstructed access to your property and pool area on your scheduled service day. This includes ensuring gates are unlocked, aggressive pets are secured indoors, and pathways are clear. If a technician cannot safely access the pool area, the job will be rescheduled and a standard trip fee may apply.

  • Work Authorization: Approving an estimate online, via text, or through our field service portal constitutes a formal work order. Major renovation or structural projects may require an additional signed project contract detailing material milestones.

Specific Service Boundaries

  • Dye Leak Detection Limitations: Our leak detection service is strictly limited to a Visual Dye Leak Detection method (using specialized dyes to trace visible structural fissures, light fixtures, main drains, or skimmer throats). We do not perform in-depth electronic, pressure, or sub-surface line testing. A dye test is a localized diagnostic tool; it does not guarantee that further undetected leaks do not exist elsewhere in plumbing lines or deep structural soils.

  • No Cleaning Services: We do not offer pool cleaning, skimming, brushing, chemical balancing, or routine water maintenance services. The pool owner is entirely responsible for the cleanliness and sanitation of the water.

Payment Terms & Cancellations

  • Payment Due Date: Payment for dye leak detection, diagnostic visits, and completed minor repairs is due immediately upon completion of the service and receipt of the invoice.

  • Renovation Deposits: For equipment replacement or full pool resurfacing, a deposit is required before materials are ordered or work begins. Deposits are non-refundable once custom materials are ordered or site prep has commenced.

  • Late Fees: Invoices unpaid after 15 days are subject to a late fee, and any pending repair work will be halted until the balance is paid.

Operational Realities & Customer Responsibilities

  • Water Levels: For repairs and dye tests to be accurate and safe for equipment, the pool owner must maintain proper water levels (generally midpoint of the skimmer). We are not responsible for equipment damage caused by low water levels occurring outside our active work windows.

  • Workspace Clearances: The area surrounding the pool equipment pad (pumps, filters, heaters) or target repair zones must be kept clear of overgrown landscaping, debris, or junk to ensure a safe, code-compliant workspace for our technicians.

Warranties and Limitation of Liability

  • Equipment and Materials: Manufacturer warranties for installed equipment (pumps, filters, heaters, automation) are passed directly to the customer. Warranty claims must be handled through the respective manufacturer.

  • Limitation of Liability: To the maximum extent permitted by Florida law, Whitestone Super Shark Pools LLC is not liable for pre-existing structural decay, structural settling, or subsurface plumbing failures. Our liability is strictly limited to the dollar value of the specific repair or diagnostic service provided.

Governing Law

These Terms are governed by the laws of the State of Florida. Any legal actions or disputes arising from our services must be resolved in the courts located in Sarasota County or Manatee County, Florida.
